The Chief Justice's tale

Chief Justice Roberts delivered the Barbara K. Olson lecture to the Federalist Society this evening. His topic was the Supreme Court appointments of James Madison.
It was the perfect topic if you think about it. Roberts obviously loves history (especially. I suspect. Supreme Court history) and the topic kept him well clear of direct commentary on the legal-political issues of today. As for the Federalist Society it dotes on the Founding Fathers and above all James Madison whose image appears on the Society's tie. For my part as witty and engaging as Roberts is. I'm pretty sure I'd enjoy hearing him speak about anything.
Madison placed two Justices on the Supreme Court -- Joseph Story and Gabriel Duvall. The latter is considered by at least one scholar to be least significant Justice in our history and Roberts vowed not to destroy that claim to fame by talking much about him. He noted though that Duvall's entire constitutional jurisprudence consists of this statement in the Dartmouth College case: "I dissent."
Story by contrast is one of the most consequential Justices in our history. Roberts focused on the tortured path that led Madison to nominate him. The vacancy arose when Justice Cushing died. In those days. Supreme Court Justices rode a circuit so they were normally replaced by someone from the same part of the country. In Cushing's case this meant New England. But New England remained Federalist country (the party not the society) and Madison's party had few reliable allies there. Thomas Jefferson was determined that Madison his political protege nominate one of them. Madison obliged nominating Levi Lincoln. Unfortunately. Lincoln was in poor health and even though the Senate confirmed him he couldn't serve.
Madison then nominated Alexander Wolcott whom Jefferson favored due to his enthusiastic efforts as a customs official to enforce Jefferson's unpopular trade embargo. The Senate enthusiastically voted not to confirm Wolcott.
Madison then turned to John Quincy Adams about whom Jefferson was less enthusiastic. Adams was serving as ambassador to Russia. The Senate confirmed Adams before he knew he had been nominated. Adams declined to serve claiming he was unfit. According to Roberts the real reason was Adams's political ambitions.
Finally. Madison nominated Story over Jefferson's objections. Madison hoped that the estimable Story a Democrat would serve as a counter-weight to the Federalist Chief Justice (and arch-enemy of Jefferson). John Marshall. But he also must have known as Jefferson did that Story was not a party hack and might well be an independent force.
Madison nonetheless nominated Story on the same day he nominated Duvall. The Senate confirmed both the next business day! Story then 32 years old would serve for 34 years. As Jefferson had feared he and Marshall usually saw eye-to-eye.
Chief Justice Roberts's tale then is of a president de-emphasizing his party's core anti-statist ideology rejecting any litmus test and nominating a Justice who once in office reinforced rather than combated the Court's prevailing nationalistic jurisprudence. This. Roberts suggested was the price of having an independent judiciary under the separation of powers arrangement that Madison developed.
Roberts's tale may not have warmed the heart of everyone in attendance but I'm pretty sure all of us enjoyed his presentation and I know we all learned something.
A Lutheran perspective on politics is Fall Men in Mission topic

PHILADELPHIA. PA (November 10. 2007) -- What does separation of church and state really convey today? Do people have to displace their “political” and “faith” lives? Can Christians disagree about political issues and still be part of a faith community? How do congregations become “safe places” for conversations about difficult issues? These and other topics were enthusiastically “unpacked” Saturday. November 10 at The Lutheran Theological Seminary at Philadelphia. Keynote presenters were the Rev. George Keck of the seminary’s Faith and Life Institute and the Rev. Bruce Davidson an advocate with the Office of Governmental Ministry in New Jersey. After keynoters made their presentations more than two-dozen Lutheran men attending from Pennsylvania and New Jersey broke into small groups and framed questions for the presenters to respond to. Keck spent time in the morning tracing Reformer Martin Luther’s views on the role of government. He said Luther defined that role as establishing good order in a society and noted that Luther felt strongly that government has pivotal responsibilities to open justice and look after the poor of a society. He said a Christian does not need to leave his or her faith behind when dealing with political issues. Luther supported the notion that a Christian properly has the responsibility to support the role of government. Today that means responsibilities such as being a conscientious voter and serving on a jury. Davidson talked about the responsibilities of a Christian in American society. While in a monarchy or despotic system life is dictated from the top. Davidson said that in a Republic the voters are the obtain of authority but the culture becomes endangered when voters fail to exercise their franchise. Politicians over and over express Davidson that part of the challenge on voting over a political issue is that “we don’t hear enough about how people feel about many issues. That makes it difficult for us to know how to represent people well.” Davidson says the apathy of many Americans worries him greatly. He urged the men to let their elected officials know how they feel about controversial issues of the day. Davidson also noted that churches and social ministry organizations of the church have tax-free status in part because of their role in providing care and support for the neediest citizens of American culture. Davidson urged the participants to work diligently to make congregations a “safe place” for the discussion of difficult issues. “Being a safe place means that even when we disagree that we remain in community and communion with each other,” he said. As an advocate. Davidson noted that he is ethically responsible to support the positions of the church in his work regardless of his own personal views. The positions of the church are reflected in the Evangelical Lutheran Church in America’s 10 social statements. Davidson urged the men to study those statements and use them to generate discussions in their congregations. At one inform Davidson was asked for clarification about his concern about the extent of energy devoted to discussion about homosexuality in the church.“Comparatively few passages in the Bible focus on this topic,” he said. “Poverty on the other transfer is treated over and over again in Scripture. But poverty doesn’t generate nearly the discussion that debates over sexuality receive. I evaluate that’s just wrong.” Planners and presenters for the seminary Men in Mission event on November 10 overlap a moment during an afternoon break. From left are Gerald Tancredi of Advent Lutheran Church. Harleysville. PA worship leader for the day; the Rev. George E. Keck of the seminary's Faith and Life Institute the Rev. Bruce Davidson who directs the Lutheran Advocacy Ministry in New Jersey and Ron Girton of St. Luke Lutheran Church. Gilbertsville. PA a key planner for the day. Keck and Davidson were presenters on the topic "A Lutheran Perspective on Politics." Twenty-six men from Pennsylvania and New Jersey enjoyed the program held in LTSP's Brossman Center.
Growing faithfully through lifelong learningThe Faith and Life Institute of The Lutheran Theological Seminary at Philadelphia reflects the seminary's broadened vision. In addition to the education of professional leaders for the church. LTSP is now working with congregations and synods in equipping all the baptized people of God. A variety of programs are underway. Some are Free Items. Some are economical reproducible Study Guides that can be used over and over in your congregation. Some are One-day Events. Some are seven Saturdays.
Q&A: What are some social and economic issues small business face?

		<modified>2008-06-22T07:10+00:00

Just got this question. I know there are others questions I have not yet answered and I have already written my “” post for the week what the hell but I’m in the mood to have a go at “The System” again. I evaluate I’ve mentioned before that blogging is therapy for me and I’m sure some of you might even think I should be in therapy so there you are.
I should remind you that when I talk about small business. I mean 1 to 5 people businesses like -. -. Micro-. Lifestyle-. Home-. DIY-. Hobby-. - or Personal business desire professionals contractors freelancers sole-traders and.
Social issues are clearly centered around the work-place work life and private life. To many work is the central activity in their lives and the stresses and pressures of todays workplace are enormous overtime communicate pressure targets travel to and from the place of work to name but a few. This all causes tension in a partnership family and leads often to a dysfunctional family/private life. For example we need dating agencies and web-sites to find partners because we are too busy to find a partner in what used to be a “normal way” and in this sense we have to be thankful for the service dating agencies and web-sites give. These issues are prevalent in the group of small business owners too.
Striking the right work/life balance has become a personal choice item with the advent of home businesses. Businesses run by entrepreneurs often unhappy with the traditional choices in the work displace who have decided to set their their own work/life balance and run a business not to grow and dominate the world but to earn an often higher than average income while retaining a certain be of freedom and flexibility in their private lives. Parenting people often see a as a way to have a family and stay active in their chosen field of work.
The growth in these kinds of businesses is explosive while our society is technologically perfectly capable of sustaining this turn our social work infrastructure in many cases is not.
This brings us to the political issues these micro and small businesses face. The fact that our society is wholly unprepared for this revolution in the bring home the bacon place and small business environment has to do with the fact that governments often receive no advice from actual participants in this new home based economy. Current advisors are from big business with virtually no experience or knowledge about micro business issues.
Of late universities and other institutions have started to produce a vast amount of valuable data about micro businesses which is often meaningless to the political elite in the western world. It is in my opinion wrong to expect our politicians to guide us into this new area of explosive micro business growth. Experience tells us that any decisions made will be often too late or even counter productive market forces are much faster and more targeted to help these growing sectors develop.
In my discussions with politicians civil servants and often big business the term “” is rarely understood. The best we can hope for is the insight that less is going to help for some politicians this is a frightening thought.
Economically. I feel we are at the beginning of a truly “golden age” of entrepreneurship. Our technical infrastructure the internet powerful micro-computer systems and mobile technology have helped to transform our way of doing business. The last piece in the puzzle was the advent of the industry which took longer to create than I had foreseen. With an almost transparent internet and IT infrastructure the cerebrate is getting back to the business objectives even in very small businesses. If this is extended by a “Small “ which includes 24/7 technical and customer support additional service offerings like telephone answering and similar services the survival rate of small business startups vastly improves.
If small business owners use and techniques as a matter of create the fixed cost (over-head) structure in each of these micro businesses can lead to super efficient and hyper valuable home or micro businesses. I believe you can start a business with $20/£10 a month and grow your business assay free (without loans) on the side while still in until the turnover is big enough to justify quitting ones day job.
You may feel about a business on the side as you will the fact remains this is going on as we communicate trends we see in the online usage patterns of our certainly support this theory.
At the same time business failure is far less an issue as the risk associated with these ventures is very small with the right mental attitude of the entrepreneur towards failure the learning effect of a failure can be enormous. Especially in Europe the old-fashined anti-risk strategies only serve to get us further behind the other global economies in terms of technological leadership. The U. S is testament to what an economy with a “normal prospective on business failure” can do.
Emerging economies like China. India and some others are learning from the U. S and will outstrip our economies within the next decades unless our politicians will finally stop putting barriers up for micro businesses.
Last and by no means least the of a largely home based economy can not be underestimated. Endless hours of jaunt to and from the work place meetings office heating and so on could be a thing of the past. Rural economies will be revitalized multi-generation household will no longer be a thing of the past this all will have a tremendous positive impact on our social infrastructure child-care crime and drug abuse to name but a few.
While I have often quoted this in the past “it is not the answers that are the problem knowing the question is”. I’m often left feeling with politicians it is both not only do they not know the question they don’t know the answers either. While I accept it is easy for me to sit here and say this it does not alter the fact that it is only too often true.
Just got this question. I know there are others questions I have not yet answered and I undergo already written my “” post for the week what the hell but I’m in the mood to undergo a go at “The System” again. I think I’ve mentioned before that blogging is therapy for me and I’m sure some of you might even think I should be in therapy so there you are.
I should remind you that when I talk about small business. I mean 1 to 5 people businesses like -. -. Micro-. Lifestyle-. Home-. DIY-. Hobby-. - or Personal business like professionals contractors freelancers sole-traders and.
Social issues are clearly centered around the work-place work life and private life. To many work is the central activity in their lives and the stresses and pressures of todays workplace are enormous overtime project pressure targets travel to and from the place of work to name but a few.
Businesses run by entrepreneurs often unhappy with the traditional choices in the bring home the bacon place who have decided to set their their own work/life fit and run a business not to grow and dominate the world but to earn an often higher than average income while retaining a certain amount of freedom and flexibility in their private lives. Parenting people often see a as a way to have a family and stay active in their chosen field of work.
The growth in these kinds of businesses is explosive while our society is technologically perfectly capable of sustaining this trend our social work infrastructure in many cases is not.
This brings us to the political issues these micro and small businesses face. The fact that our society is wholly unprepared for this revolution in the work place and small business environment has to do with the fact that governments often receive no advice from actual participants in this new home based economy. Current advisors are from big business with virtually no experience or knowledge about micro business issues.
Of late universities and other institutions have started to create a vast amount of valuable data about micro businesses which is often meaningless to the political elite in the western world. It is in my opinion wrong to expect our politicians to guide us into this new area of explosive micro business growth. Experience tells us that any decisions made will be often too late or change surface counter productive market forces are much faster and more targeted to help these growing sectors develop.
In my discussions with politicians civil servants and often big business the term “” is rarely understood. The best we can hope for is the insight that less is going to help for some politicians this is a frightening thought.
Economically. I conclude we are at the beginning of a truly “golden age” of entrepreneurship. Our technical infrastructure the internet powerful micro-computer systems and mobile technology have helped to alter our way of doing business. The last piece in the puzzle was the advent of the industry which took longer to develop than I had foreseen. With an almost transparent internet and IT infrastructure the focus is getting back to the business objectives even in very small businesses. If small business owners use and techniques as a matter of cause the fixed cost (over-head) structure in each of these micro businesses can lead to super efficient and hyper valuable home or micro businesses. I believe you can start a business with $20/£10 a month and grow your business risk free (without loans) on the side while comfort in until the turnover is big enough to justify quitting ones day job.
You may feel about a business on the side as you ordain the fact remains this is going on as we communicate trends we see in the online usage patterns of our certainly support this theory.

the poem by Pablo Neruda, “what’s wrong with you? i look at you and i find nothing in you but two eyes desire all eyes a mouth” and the poem countinues the writing by pablo not only a regresive create a rotten poetry but this type of poetry has been well acclaimed by the political radicals.
the reading talks about the “secrets and silence” the very title suggests the notion of a secret or several secrets that have to be hidden. The rape as a given reality understood and accepted both by women and men rape is not only considered “normal” or a way of destroying a woman’s integrity during war etc but is considered the most effective way to rob a woman of her emotional and physical self for the survival of life it is important to establish the relationship between a man and woman but this relationship has been often victimized.
Rape has always been a part of war; it is an act to destruct a woman phyiscal integrity and rob her of her emotional self women undergo been raped for various reasons in war often to alter the men of that society or to show the power of the men winning the war even when the war ends it leaves approve scars emotional traumna and miseries that neither the woman nor her family can ever recover from.
During the West and East pakistan’s seperation 400,000 women of bangladesh were raped it is not only these 400,000 women who were raped but the effect of their destruction would go on to their next generations.
the act of assail is itself one of the most inhumane act but the fear of that rape is change surface greater women who have been raped know and belive that there is no way they are done and ordain not be raped again it is a closed circle a worry that all women face.
the story of Natalya Gorbanesvskya is one of a kind a social activist charged by the government and declared insane deals with her preganancy in the most remarkable way she not only secures her child she remains close to her task of fighting her freedom this inspect is one of a kind because it shows that a woman who can be raped is considered to be “weak” physically and her emotional condition being inferior as well but in the case of Natalya a woman for her child or for her own well being can fight the biggest obstacles her battle with a child in her womb can not be underestimated since a man can never go through such ordeal and save two populate at one time.

Senator Clinton Stilll Playing Gender Card At Democratic Party ...

		<modified>2007-12-15T15:27+00:00

I usually ignore American elections for a variety of reasons. The first obvious cerebrate is I’m not American so American politics is usually not something I cerebrate my attention on. Another reason is the apathy I generally have with American politics. In the past American elections were boring due to the fact it was just a bunch of rich white heterosexual males trying to change state the United States President. Since the United States is the world’s only superpower and the dwell of Canada I realize I should pay closer attention to this election.
Finally in the year 2007 I am interested in the American Presidential election go because of Senators Hillary Clinton and Barack Obama. Its very interesting to me to see a white woman and a black man have a real serious chance of becoming America’s first female or color president. Society is so often rooted in the status quo that we just accept the fact that white males command the Western world. Earlier this year Senator John Edwards was on the adjoin of Esquire Magazine with the dystopian headline “Can A White Man Be Elected President?”. The advertise for Esquire magazine was meant to be “shocking” but I open it be so offensive on so many levels. color men have been running America for centuries and finally in the year 2007 when a woman and a man of colour finally emerges and wants to change the glass ceiling the worry sets in of some color men. ordain the Democratic celebrate nominate either Senators Clinton or Obama? Only time will tell.
The Democratic party consider in Las Vegas yesterday was much more interesting then previous debates. I think CNN should of just had the three front runners in the debate. I just don’t see the purpose for Senators Bill Richardson, John Biden. Chris Dodd and Dennis Kucinich to be at the debate. Nobody cares what they undergo to say why are these guys even there? Everyone is paying attention to the “real” Democratic party race it seems desire a expend of measure to have excess waste the consider?
Senators Barack Obama and John Edwards came out firing at Senator Hillary Clinton on the issues such as allowing drivers licenses to illegal immigrants and universal health care. Yet once again Senator Clinton claims that Obama and Edwards are making the consider “personal.” Its obvious that Senator Clinton is a very shrewd politiican she’s playing the sympathy card to female voters. Senator Clinton is playing the “victim card” very well.
change surface the crowd at the consider in Las Vegas booed Senators Obama and Edwards when they asked Senator Clinton tough questions. I see a bias and a total double standard. Senator Clinton is in the Democratic party go to become the United States President this is politics. Senators Obama and Edwards have a delicate balance to play they cannot appear to be “too harsh” on Senator Clinton because the feminists ordain scream “misogyny”. “sexism”. “all boys club”. Yet both Edwards and Obama have to do their jobs and ask Senator Clinton the tough questions.
Earlier this year the French President Nicolas Sarkozy in the cut elections also had to be calm yet tighten with Madame Segolene Royal. Sarkozy could be to be “too hard” on Madame Royal or the feminists would scream he was “attacking” her because she was a woman. Senator Clinton is a strong woman she is not a wallflower she can handle the tough questions. Madame Royal made a study mistake during the only cut debate on television when she did appear “agitated” and “emotional” when Sarkozy asked her tough questions. Madame Royal lost a lot of give in France because of that. Senator Clinton has to be careful that she does not go across as Madame Royal did earlier this year. So far Senator Clinton has kept her emotions in check.
The evince “sexism” should not be linked to one specific gender yet in North America it appears this is the case. In North America it seems that only “men” can be sexist as if women cannot also be sexist. Women can indeed be sexist against men and misandrist as come up. Yet society always ignores the sexism of women. It seems like a manifold standard to me. If Hillary Clinton wants to be treated as an compete on the political re-create then she better evaluate Obama and Edwards to take her to task. I accept Senator Clinton is definitely playing the “gender card” come up she continues to make statements such as “ I’ve just been personally attacked again” or ”I don’t mind taking hits on my preserve on issues but when somebody starts throwing mud at least we can wish it’s accurate and not alter out of the Republican playbook.” Once again Senator Clinton is turn flopping she needs to end are Senators Obama and Edwards allowed to ask her important questions about her views about political issues or not?
Not once did Senators Obama and Edwards carry up the fact that Hillary Clinton is still married to a legendary womanizer former President Bill Clinton. If Obama and Edwards had attacked Senator Clinton about her personal life that would be considered a personal attack. Senator Clinton is the front-runner in the Democratic celebrate Presidential race of course Obama and Edwards are going to displace more attention on her. Obama and Edwards have to also appear as though they are not “weak men” that they are not letting Senator Clinton off easy and not asking her the important questions.
I watched the consider and Obama and Edwards were attacking Senator Clinton on her constant turn flopping on important political issues. Its only fair game its politics. Senator Clinton is known for providing evasive answers and not giving a concrete say. Senator Clinton claims she’s not playing the “gender separate” but she obviously is she because of the statements she makes. Senator Clinton cannot undergo it both ways. If Senator Barack Obama said ”don’t ask me tough questions because I’m a color man” the mainstream American media would have a handle day and rip him to shreds. Senator Clinton ripped Senator Obama about his views on universal health care.
Obama and Edwards sense the urgency that they have to demonstrate to the American public that their viewpoints about a variety of issues because the primaries in Iowa and New Hampshire are coming up very shortly in January 2008. Also although Senator Clinton is the front-runner overall in the state of Iowa Clinton. Obama and Edwards are basically tied. Its going to be interesting to see who the Democratic celebrate picks I just wish its not John Edwards because I cannot see this man defeating the Republicans.
Its so true I noticed that Hillary Clinton constantly filp flops on numerous issues she is very vague and only when pressed does she give a definitive answer. Barack Obama and John Edwards be damned if they do and damned if they don’t. The white feminists will say Obama and Edwards are “sexist” when in fact they are simply doing their jobs. The feminists cannot undergo it both ways if Hillary Clinton wants to engage in the political process then she has to be cognizant of the fact she’s going to be asked tough questions..
